Can codifying rules of constitutional interpretation strengthen the rule of law, democracy, and federalism rather than undermine them?
This question comes from debates about judicial discretion. Some systems rely on interpretive doctrines rather than codes. I want to understand the institutional trade-offs.

From my experience, codification can enhance transparency but rarely eliminates discretion. I have seen interpretive codes clarify baseline commitments, especially in federal systems, yet judges still exercise judgment in hard cases. Over-codification risks freezing constitutional meaning and weakening democratic evolution. I would recommend limited codification that articulates guiding principles rather than rigid rules, preserving interpretive flexibility while reinforcing legal predictability.
