The jurisdiction of a Nigerian State High Court over criminal matters is primarily derived from the 1999 Constitution of the Federal Republic of Nigeria (as amended). Section 272(1) confers unlimited jurisdiction on State High Courts to hear both civil and criminal cases. In relation to the offence of affray, the substantive legal basis is found in Sections 71 and 72 of the Criminal Code Act, which define the offence and prescribe punishment. These provisions apply in the southern states of Nigeria, thereby supporting the court’s authority to adjudicate such cases.
